Mesothelioma Medical Experts Oppose Asbestos Trust Fund, Saying FAIR Act Hurts More than Helps
NEW YORK, Feb. 9 /PRNewswire/ -- The Doctor-Patient Alliance for Responsible Asbestos Policy today repeated its call on the U.S. Senate to cure fatal flaws in the proposed Asbestos Trust Fund bill (SB 852).
Last July, the nationwide group of 34 doctors who treat mesothelioma patients urged the U.S. Senate to remove the "one-size-fits-all" cap on awards and install a due process hearing, at which patients could prove their special medical and financial hardship damages and have their award tailored accordingly. The claims review system would be modeled after the 9/11 Victims Compensation Fund.
In addition, the Doctor-Patient Alliance asked for assurances that dying mesothelioma patients would be fairly compensated during their shortened life span. The detailed letter was sent to all 100 U.S. Senators.
"We are disappointed that our suggestions were ignored," said Dr. Harvey Pass, Chief of Thoracic Surgery at New York University Medical School. "This bill presented an historic opportunity to enact legitimate reforms that would directly benefit present and future meso patients. Regrettably, the bill actually hurts more than helps meso patients."
"The $1.1 million cap is insufficient to meet the medical, hospital, travel, lodging and other costs of mesothelioma patients who pursue the best treatments, which include surgery, chemotherapy, radiation, or a combination of therapies," said Dr. Robert Cameron, Chief of Thoracic Surgery at UCLA Medical School. "The inflexible cap fails to address the ongoing medical costs of patients who survive long enough to outlive the median survival time but who remain disabled and unable to earn a living. The bill ends up discriminating against the early stage, usually younger, patients whose life- long medical costs are certain to exceed their award.
"Mesothelioma must be treated as a chronic disease that requires a lifetime of care and treatment," said Dr. Cameron. "The costs of staying alive will far surpass the bill's arbitrary cap. Worse, some patients may decide against expensive novel treatments to stockpile the meager 'compensation' for their family."
In addition, the Alliance argues that any awards should be made while the money can be effectively invested in life-extending cures. "I doubt very much that the new bureaucracy will be up and running within my life time," predicts Dr. Bret Williams, age 52, a two year meso survivor who has incurred over $600,000 in medical bills. "It will take at least two years for the new federal agency to start paying out claims, while the median survival for mesothelioma patients is about nine months."
Dr. Williams, who has resolved his third-party civil claim, noted that most states have laws that allow in extremis meso patients to obtain preferential trial settings. For example, in Colorado and California, courts are required to set hardship meso cases for trial within 120 days. "I don't buy the rhetoric that an untested, under funded and at this point non-existent federal agency will pay out fair compensation faster than the court system," said Dr. Williams.
The Doctor-Patient Alliance has concerns that the bill will unduly restrict access to the Fund based on industry-friendly exposure criteria. "The Bill provides only for those with prolonged, occupational exposure. It excludes those with neighborhood exposure, or exposure only in schools or homes or while doing 'shade tree mechanic' work. It completely knocks out the first responders to the World Trade Center collapse," said Dr. Williams.
"My family would not have been compensated under the Trust Fund, since I was exposed while doing sporadic home repairs and while working with vermiculite potting soil," noted Dr. Williams.
"The U.S. Senate should correct these serious flaws or start over," said Dr. Pass. "Our government must do better when it comes to federal compensation initiatives. Recent studies of similar programs, like the Black Lung fund, make me skeptical that the asbestos trust fund will work. The motives may have been noble, but every federal compensation program to date has been marred by much higher costs, more claims than predicted, serious delays in meeting the demand and long intervals between the date the bill became law and the day the government started writing checks."
"I have a message for Dr. Frist," said Dr. Williams. "We belong to a privileged profession. Years ago, we dedicated ourselves to healing the sick, to caring for people from all occupations. It's been said that politics is 'medicine on a grand scale.' The principles guiding patient care should inform your decisions today. Let's ban asbestos. Let's fund research on effective treatments to stave off the asbestos health crisis. But let's not bail out industry at the expense of victims. Dr. Frist, do no harm."

New Research Grants Continue Progress Against Dread Cancer
Mesothelioma Applied Research Foundation Announces Additional $1 Million of Research Funding
SANTA BARBARA, Calif., Feb. 23 /PRNewswire/ -- The Mesothelioma Applied Research Foundation ("MARF") announced today awards of almost $1 million in additional research funding aimed at curing mesothelioma ("meso"). An international and cross disciplinary set of nine new projects will go forward thanks to grants from MARF of $100,000 each. Researchers in Holland, Australia and the United States combined their efforts to field a broad spectrum of investigative efforts that are certain to advance the pace and scope of research success against this deadly cancer. Meso is a malignant tumor related to asbestos exposure that aggressively invades the mesothelial linings of the lungs, abdomen, heart, or testicles.
MARF's scientific experts selected the nine projects as the most important and promising among 28 high caliber applications received from around the world. For each of these two-year projects, the researchers are bound by strict budgeting and progress reporting requirements. Funds for the first year were paid in late 2005 and the research is now underway.
In a Phase I clinical trial focused on immune therapy, Doctor B.N.M. Lambrecht of the Erasmus Medical Center in Rotterdam, the Netherlands, plans to evaluate dendritic cells as a therapeutic adjuvant for treating malignant meso in humans. This grant follows up on previous successes with immunotherapy studies in mice that were very effective and also funded by MARF. Dendritic cells proved capable of generating an immune response when presenting meso tumor antigens and the current study intends to test the feasibility and safety of this approach.
Hot on the heels of meso-specific serum biomarker announcements in late 2004 and early 2005, researchers at USC under the direction of Dr. Ite Laird-Offringa were given a grant to continue investigating diagnostic markers for meso. USC plans to use DNA microarray chips to pre-screen 6500 serum markers using the MethyLight analytical system. Tissue samples would be examined to identify specific molecular markers found in meso tumor specimens with an eye to developing new serum tests to aid early diagnosis of the cancer.
The molecular understanding of the human genome has allowed researchers to undertake much more precise and tactical interventions against meso. Professor Xiaobo Cao of Texas A&M University, and his team, received a grant to investigate a specific gene family bcl-2, known to over-express a protein BCL-XL which blocks cell death (apoptosis) in mesothelioma tumors. Researchers wish to evaluate a bcl-2/bcl-xl antagonist, a compound that blocks the actions of the over-expressed protein, to see if it will cause tumor cell death and sensitize meso cells to the effects of existing chemotherapy agents. Such studies were virtually impossible ten years ago and represent the leading edge of scientific research today.
A Nevada Cancer Institute team under the direction of Dr. Sunil Sharma will continue its investigation of suberoylanilide hydroxamic acid (SAHA), a histone deacetylase (HDAC) inhibitor. SAHA and other HDLC inhibitors have demonstrated broad cancer activity and provide a promising new approach to therapy. Tumor resistance to HDAC inhibitors will be studied in an effort to identify combination therapies with mTOR inhibitors and nutrient uptake inhibitors that can increase tumor response to treatment. Dr. Sharma intends to generate a meso cell line resistant to SAHA and other drugs like valproic acid and then compare them to parent cell lines using molecular analysis to identify markers of resistance. These markers will then become targets for therapy.
MARF funded five other, equally innovative and important studies in this latest round of grants. Some of these research grants will become stepping stones; used to provide sufficient data to propose and win larger research grants from the National Institute of Health (NIH) and other government agencies. Using this approach, MARF-funded projects have had a multiplier effect on the total research investment into a cure for mesothelioma. Taken together, these studies have achieved, and will continue to achieve, results far in excess of what MARF could have accomplished alone. Without MARF's investment, however, little progress would have taken place.

Mesothelioma Test A Breakthrough

April 19, 2005 - AUSTRALIAN researchers have developed a world-first blood test which could help in the early detection of mesothelioma, a deadly asbestos-related cancer of the lung lining.
About 700 people every year are diagnosed with the disease in Australia, which has the highest reported incidence in the world.
It can take up to 30 years for symptoms of the condition to develop so most sufferers are identified at an advanced stage and die within a year.
The non-invasive blood test developed by University of Western Australia Professor Bruce Robinson and a team of researchers is a breakthrough in the early detection of mesothelioma.
Under existing arrangements, diagnosis is a long process which includes blood tests, chest x-rays, CT scans, drainage and laboratory analysis of the pleural fluid to help differentiate mesothelioma from other similar conditions.
The new blood test, named MESOMARK, was originally developed for cervical cancer at the Pacific Northwest Research Institute in the US, but Professor Robinson has adapted it for testing mesothelioma.
Dr Nick Pavlakis, a leading mesothelioma researcher in Sydney, said the blood test would be a valuable diagnostic aid for doctors.
"The test is a breakthrough because it's a simple blood test, it could therefore be applied to patients who are at risk, those who have a history of exposure or symptoms of the disease," he said.
The blood test measures the amount of protein in the blood, and a patient who returned a low reading would register a negative result.
But if the patient returned a high reading they would be sent for a second test to confirm the result.
Former painting contractor Erl Carlsson, who has mesothelioma, said the test would be valuable in monitoring the health of his family.
Mr Carlsson, 59, who lives in Narrabeen, on Sydney's northern beaches, was diagnosed with the disease in October last year after 30 years of sanding back asbestos fibro in his work as a painter.
He is now concerned for the health of his wife Barbara, who washed his clothes with asbestos dust on them, and children Andrew, 31, and Jenny, 32, who often worked with him when they were younger.
"It would really help the treatment, it's usually 20 or 30 years before you find out you have it ... it could have helped me too," Mr Carlsson said.
Dr Pavlakis said the amount of people diagnosed with the disease was expected to peak between 2010 and 2020 when the symptoms had fully developed.
"What we are seeing today is a product of exposure decades ago, so even though the legislation changed to reduce occupational exposure to asbestos fibres we have a decade lag time between the exposure and the disease," he said.
Symptoms for mesothelioma include breathlessness and chest pain.
Treatment, including chemotherapy, radiotherapy and surgery, aims to prolong life and keep the person as comfortable as possible.

Chronic pain, the most costly health problem in America today, often responds within minutes to EFT, a simple do-it-yourself acupressure technique.

IMHC, along with a planning group comprised of People Living with HIV and AIDS, public health leaders, elected officials, and faith, community and business leaders, will engage in advocacy and action days around the state culminating with a march from Monument Circle in Indianapolis to the Indiana State House on April 19, from 1 -3 p.m.; and the 12th annual initiative luncheon featuring an international celebrity, humanitarian and HIV/AIDS spokesperson on April 20 at The Westin Hotel, in downtown Indianapolis, from 11 am 2 pm.
Since 1981 when the first cases were diagnosed, AIDS has killed more than 20 million people, in the minorities/ethnic communities, accounting for 40 percent of those deaths. In addition, in the United States racial/ethnic minorities account for more than 40 percent of the estimated 944,306 AIDS cases that have been diagnosed, making up 12.2 percent of the population.
To address this health concern, IMHC will work with community members to encourage them to take action within their counties. The organization is partnering with the 12 regions for the initiative, based on care coordination sites defined by the Indiana State Department of Health. Volunteers and participants in each region will receive HIV/AIDS Issues and Action Toolkits that will include current Indiana HIV/AIDS data and talking points that affect those infected and impacted; guide communities on developing their own local events; and develop methods to engaged elected officials such as the HIV/AIDS education day.
HIV/AIDS education is the priority for the initiative with the key message of getting support for the HIV Gap Fund to help save Hoosier lives. The fund is critical to Indiana residents who lack financial and social support resources. People living with HIV/AIDS and other life altering diseases are in a difficult position because they can not absorb the high cost of medications. Some HIV/AIDS medications alone range from $800-$1,250 per person per month.
The HIV Gap Fund will provide individuals with resource to help obtain their medication if they are faced with shortfalls in insurance, co-pays, spend downs or lack of social services.
IMHC is dedicated to closing the gap in health care in our communities. We are rallying to save the lives of our loved ones, neighbors and co-workers. Avian Influenza: Significance of Mutations in the H5N1 Virus
GENEVA, Feb. 21 /Xinhua-PRNewswire/ -- Several recent media reports have included speculations about the significance of mutations in H5N1 avian influenza viruses. Some reports have suggested that the likelihood of another pandemic may have increased as a result of changes in the virus.
Since 1997, when the first human infections with the H5N1 avian influenza virus were documented, the virus has undergone a number of changes.
These changes have affected patterns of virus transmission and spread among domestic and wild birds. They have not, however, had any discernible impact on the disease in humans, including its modes of transmission. Human infections remain a rare event. The virus does not spread easily from birds to humans or readily from person to person.
Influenza viruses are inherently unstable. As these viruses lack a genetic proof-reading mechanism, small errors that occur when the virus copies itself go undetected and uncorrected. Specific mutations and evolution in influenza viruses cannot be predicted, making it difficult if not impossible to know if or when a virus such as H5N1 might acquire the properties needed to spread easily and sustainably among humans. This difficulty is increased by the present lack of understanding concerning which specific mutations would lead to increased transmissibility of the virus among humans.
Animal viruses
Virtually all the known subtypes of influenza A viruses circulate in some wild birds, most notably wild waterfowl. In these birds, different viruses constantly mingle with each other and frequently exchange genetic material, resulting in a huge pool of constantly changing viruses. Mutations and reassortment events are commonly observed in the affected bird populations.
In animals, some recent evolutionary changes in the H5N1 virus appear to have made control efforts more difficult and further international spread of the virus in birds more likely. Such changes are fully understandable, particularly in view of the exceptionally large number of birds that have been infected with the H5N1 virus and the frequent interactions between infected free-ranging poultry and wild waterfowl.
Studies have shown that H5N1 viruses from the current outbreaks, when compared with viruses from 1997 and 2003, have become progressively more lethal in experimentally infected chickens and mice, and are also hardier, surviving several days longer in the environment. Other studies have shown that the virus is not yet fully adapted to poultry and is continuing to evolve.
Domestic ducks have acquired an ability to resist the disease caused by some strains, and are now capable of excreting large quantities of highly pathogenic virus without showing the warning signs of illness. In endemic countries, this altered role of domestic ducks is now thought to contribute to perpetuation of the transmission cycle. Research conducted in South-east Asia has recently shown that multiple distinct lineages of H5N1 virus have become established in poultry in different geographical regions, indicating the long- term endemicity of the virus in parts of Asia. That research also detected highly pathogenic H5N1 virus in apparently healthy migratory birds.
In birds, one important recent finding has been the remarkable similarity of viruses from recent outbreaks to those isolated from migratory birds that began dying at the Qinghai Lake nature reserve in central China in late April 2005. Evidence is mounting that this event, which resulted in the deaths of more than 6,000 wild birds, signalled an important change in the way the virus interacts with its natural reservoir host.
Unlike the case with mutations of human viruses (some of which have been transient), it appears that some changes have become fixed in viruses circulating in at least some species of wild birds.
Prior to the Qinghai Lake event, the highly pathogenic H5N1 virus was known to cause occasional sporadic deaths in migratory waterfowl, but not to kill them in large numbers or be carried by them over long distances.
Viruses from Qinghai Lake showed a distinctive mutation at one site experimentally associated with greater lethality in birds and mice. Viruses from the most recent outbreaks, in Nigeria, Iraq, and Turkey, as well as from earlier outbreaks in Russia, Kazakhstan, and Mongolia, are virtually identical to Qinghai Lake viruses.
It is considered unusual for an avian influenza virus causing outbreaks in birds to remain this genetically stable over so many months. This finding raises the possibility that the virus -- in its highly pathogenic form -- has now adapted to at least some species of migratory waterfowl and is co-existing with these birds in evolutionary equilibrium, causing no apparent harm, and travelling with these birds along their migratory routes.
If further research verifies this hypothesis, re-introduction of the virus or spread to new geographical areas can be anticipated when migratory birds begin returning to their breeding areas.
The recent appearance of the virus in birds in a rapidly growing number of countries is of public health concern, as it expands opportunities for human exposures and infections to occur. These opportunities increase when the virus spreads from wild to domestic birds, especially when these birds are kept as backyard flocks in close proximity to humans.
To date, no human cases have been linked to exposure to wild birds. Close contact with infected poultry and other domestic birds remains the most important source of human infections.
Human viruses
Some mutations have been detected in human viruses isolated in 2005 and, most recently, in one virus isolated from a fatal case in the January 2006 outbreak in Turkey. Although these mutations were found at the receptor- binding site and involved the substitution of more mammalian-like amino acids, the effect of these changes on transmissibility of the virus, either from birds to humans or from one person to another, is not fully understood. Moreover, recent studies show that these mutations were transient and did not become fixed in the circulating viruses.
Scientists do not presently know which specific mutations are needed to make the H5N1 virus easily and sustainably transmissible among humans. For example, it is not known whether the absence of a specific receptor in humans for this purely avian virus is responsible for the present lack of efficient human-to-human transmission. For this reason, virological evidence of mutational changes must be assessed together with epidemiological information about transmission patterns actually occurring in human populations. This necessity further underscores the importance of close surveillance and thorough investigation during every outbreak involving human cases.
Assessments of the outbreak in Turkey, conducted by WHO investigative teams, have produced no convincing evidence that mutations have altered the epidemiology of the disease in humans, which was similar to the pattern consistently seen in affected parts of Asia. There is no evidence, at present, from any outbreak site that the virus has increased its ability to spread easily from one person to another.

Early Chemotherapy Improves Outcomes for Mesothelioma
According to a recent article published in the Annals of Oncology, immediate treatment with chemotherapy improves survival rates at one year and provides improved quality of life compared to administering chemotherapy once symptoms occur in patients with malignant mesothelioma.
Malignant pleural mesothelioma is a rare cancer that develops in the tissue that covers the lungs and lines the interior of the chest. The majority of individuals who develop malignant pleural mesothelioma have a history of chronic exposure to asbestos.
The only curative treatment for mesothelioma is surgery. However, more than 70% of patients diagnosed with mesothelioma have advanced disease, which places them beyond the curative benefits of surgery. These patients are treated with chemotherapy following surgery with the main goal of treatment being to extend survival time and improve quality of life.
Researchers from England recently conducted a clinical trial to evaluate different timing of the administration of chemotherapy in patients with malignant mesothelioma. This trial included 43 patients who had undergone surgery and had stable disease symptoms for at least 4 weeks. Approximately half of the patients then received immediate chemotherapy consisting of the regimen referred to as MVP (mitomycin, vinblastine, cisplatin, or carboplatin), while the other half did not receive MVP until disease symptoms occurred.
Overall, patients treated with early chemotherapy had improved outcomes:
- Median survival was 14 months for patients treated with immediate chemotherapy, compared with 10 months for those treated with delayed chemotherapy.
- At one year, survival rates were 66% for those treated with immediate chemotherapy, compared with 36% for those treated with delayed chemotherapy.
- Quality of life was generally better among patients treated with early chemotherapy.
- Health resource utilization was comparable between the two groups of patients.
The researchers concluded that chemotherapy prior to the onset of disease symptoms improves outcomes compared to administering chemotherapy once symptoms have occurred in patients with mesothelioma. Patients with mesothelioma may wish to speak with their physician regarding their individual risks and benefits of chemotherapy timing.

Recent interdictions of Canadian drug packages by U.S. Customs agents are part of a calculated campaign to intimidate patients who order life-saving medications from licensed online Canadian Pharmacies. Interruptions in established medical therapy are putting patients at unnecessary risk.
Calgary, Canada (PRWEB) February 13, 2006 -- The U.S. FDA has been ramping-up interdictions of Canadian drug packages in what appears to be an intentional intimidation campaign timed to coincide with the launch of the controversial Medicare Part D prescription drug program. Seizure rates at major border entry points have increased nearly ten-fold since December and are accompanied by a letter that obviously intends to frighten patients. Licensed and legitimate online Canadian pharmacies like Minit Drugs (www.pharmacy-online.ca) are reporting hundreds of seizures in the last 2 months, up substantially from previous averages.
We have historically been prepared to absorb the cost of re-shipping seized medications as a necessary business expense. But now, the FDA is on a rampage to snuff-out even legitimate online pharmacies because they pose an obvious threat to the struggling Medicare drug program, says Barney Britton, CEO of Minit Drugs (www.pharmacy-online.ca). Clearly the FDA is acting on a political agenda.
Evidence that recent seizures are part of a deliberate operation is substantiated by Mark Conrad, a retired U.S. Customs special agent, after he was contacted by an anonymous whistleblower in Miami alerting him than an intentional seizure program was underway. Officials from Customs and Border Protections public affairs office in South Florida did not return a phone call seeking comment on the operation.
The Canadian International Pharmacy Association (CIPA), a trade group in which Minit Drugs is a member in-good-standing, fears that U.S. patients could be unduly harmed as a result of the FDAs political tactics. "It's an issue of patient safety," says Andy Troszok, CIPA President. "We're not talking about Viagra and narcotics abuse. We are talking about people with breast cancer, heart disease and diabetes on established medication. Who is going to be liable for these people going off medical regimens and suffering or even dying?"

The Climb For Cancer Foundation announces two children and a cancer survivor have volunteered to be team leaders for their first annual nationwide mountain climbing event to fight cancer. Charlie Marr, 12, and Isabelle Richmond, 13, have signed on to lead teams in Maine and Illinois respectively, to climb the highest peak in their home states. Cancer survivor, Bob Mayer will be leading the Maryland climbing squad, as several other survivors of the disease have signed up as team members in various states.
The event, known as 50-50-1 will include climbing teams in all 50 states in the US, scaling the highest peak in each state on the same day. Each team will raise $5,000, which will in turn help to fund important research to find a cure for cancer, provide patient support services, and give a child with cancer the opportunity to attend Camp Sunshine. 50-50-1 stands for 50 states, 50 peaks, one goal.
It will give a chance to kids with cancer to go to camp, play sports and have fun just like I do, says Marr of 50-50-1. I hope someday that all kids with cancer are healthy enough to climb the highest peak in their state. Most importantly, I want kids with cancer to know everyone cares about people with the disease and this foundation shows that.
Isabelle Richmond added, "I would like to do something for children with cancer. My Grandmother died of cancer, so I would like to help raise money for cancer research."
The Climb For Cancer Foundation was started by Ron and Dianne Farb to combine Ron's love for mountain climbing with their desire to see an end to cancer. The Foundation acquires sponsors and donations in support of Ron's mountain climbing expeditions, and then uses the money raised to help fund cancer research and support services. Free forum will expand global knowledge about beneficial plants and trees.

Trees for Life is a non-profit organization that helps plant fruit trees in developing countries as a low-cost, self-renewing food source. The movements philosophy of education, health and environment will be evident in Trees for Life Journal, which aims to expand global knowledge about the medical and nutritional value of plants in order to educate citizens of third world countries.
The idea for the journal was born from traditional claims about the nutritional, medicinal and other beneficial properties of the tree Moringa oleifera. Every part of the tree is edible or used as traditional medicine, from the leaves to the bark to the seeds. It grows wild in poor soil and provides vitamins desperately lacking in diets of impoverished people. Trees for Life recognized the need for a forum to publish and discuss scientific studies and communal knowledge of this tree, in order to promote its cultivation in the developing world. People whose lives could be improved by research findings are not even aware such a wealth of information exists in their midst, said Mathur. Almost anyone with experience would agree that many more channels of communication are needed to increase the exchange between academics and lay people.
Trees for Life Journal will be free to users and features an easy-to-use format. Anyone may publish an articlefrom peer-reviewed field and clinical studies to informal essays or ideas for possible new uses of medicinal plants and trees. The content is also freely available for reproduction and distribution, with credit given to the original authors. The Web site also features a mentor program that matches experienced scientists with those who are new to the research process. Publishing electronically means the journal can be updated as often as necessary.
The ease and speed of this technology transcends the barriers of cost, space and time, Mathur said. Thanks to the Web, it is now possible to scale the walls that have long divided those who know and those who need the knowledge.
Dr. Doren Fredrickson of the University of Kansas School of Medicine-Wichita will be the journal's Chairman. Dr. Jed Fahey of Johns Hopkins University School of Medicine will be Editor-in-Chief and Jeffrey Faus of Trees for Life will be Managing Editor.
